Let me start with congratulating EPO with the initiate it took to develop IP focused scenarios. As demonstrated over the last days, it is an excellent way to bring stakeholders together and collectively brainstorm about what might lay ahead of us.
The first point I want to make is that businesses and the IP community are exposed to same fundamental forces and this will help to have a fruitful dialogue. To illustrate this point I like to show one Shell Scenarios slide that depicts in a simple way the forces shaping our business environment. The first force is about globalization, liberalization and competition ;. The second force is the force of community : trade blocks, new alliances of NGO, consumers, etc. The third one is the force of regulation, standardization, coercion in response to threats, insecurity and lack of trust.
The IP scenarios can be seen as reflect different trade offs between these forces.
The second point I want to make is that the IP scenarios do not fundamentally challenge the legitimacy of the IP system. Yes, the system may see changes but it is very unlikely to be abolished. Quite a relief for a representative of a company that seeks to differentiate itself through technology. Having clarity that the systems is here to stay there is no excuse for postponing actions to make the system better through improvement of quality, standardization, simplification, etc, etc. The third point I want to make is that there is indeed the need to have debates about aspects of the IP systems. Things that come to mind are the implications of the growing complexity of the technology, the implications of more open innovation systems, the accessibility of technologies needed to address major global challenges such as climate change and pandemic diseases. Businesses look forward to participating in these debates especially when these debates do recognize the legitimate interests of the each of the 3 P’s ; people, planet and profit.
