The EPO and its place in the patent system

After some considerations about Intellectual Property Rights in general, the various patent systems all around the world and their history, the role of the EPO as a regional office, its position compared to national patent offices and to other regional offices will be explained and discussed. The possible future of the European patent system will be also presented.

Patent terminology - an introduction to patentese

Newcomers to  intellectual property are often surprised or even shocked at the way words or phrases familiar in everyday language are used very differently in the world of patents.

Grammatical constructions that would be unthinkable in everyday speech or writing are used routinely in patentese. Patentese has words which do not even exist in ordinary languages. Furthermore patentese exists in every conceivable natural language version.

This presentation can be considered as an introduction to patentese, a primer. It will help newcomers to understand patentese and even help them to create their own constructions in patentese. Furthermore having learned the basics of patentese it will help them to search for patent documents.

Search basics

During this session some basic 'need-to-knows' for searching in patent databases will be addressed:

  • What are the different parts and types of information contained in a patent document?
  • What do the various terms in a patent document mean?
  • What are some basic rules for searching?
  • How can I use Boolean operators and truncations?
  • How can I construct logical expressions as search terms?

Walkthrough the EPO's patent information products

This presentation gives an overview of the patent information products & services of the EPO. The focus is on the resources used and the different ways of presenting the platforms created for users, from quick online information lookup to the official publications of the Office.

The patent information market

This presentation will review the patent information market and identify the roles and niche markets of the various suppliers in the public and private commercial sector. Some examples of patent information business models will be given. The presentation will conclude with examples and comparisons of some commercially available products and the results obtained from them. Somewhere there is that product that satisfies your needs, but how to find it without drowning?

  • PCT applications
  • European patent applications

The European patent granting procedure

  • Filing of an application
  • Formalities examination
  • Payment of fees
  • The extended European search report
  • Publication of the application
  • Substantive examination
  • Grant of the patent / refusal of the application
  • Publication of the granted patent

Euro-PCT applications

  • Entry into the European phase

Post-grant procedures

  • National phase validation
  • Opposition
  • Limitation or revocation of the European patent

The database of ideas: esp@cenet

esp@cenet is a free internet service that allows the retrieval of patent documents published by national and regional patent offices.
esp@cenet has been positioned as a principal source of technical information which is contained in the patent documents themselves. Specifically for EP and EURO-PCT publications, we will have a closer look at the links esp@cenet offers to the European Register and the Inpadoc Legal Status and Patent family information. Also the List of citing documents is important to understand the importance of a document within its technical field. We will look at how to best formulate search queries and how to set up a good search strategy to retrieve most relevant documents. We will introduce you to the Boolean operators and the truncation possibilities, how to double your keyword power by using a classification search (IPC and ECLA) and how to interpret result lists. Besides presenting the full document download function, we will also show you the other features of the esp@cenet service, for example, esp@cenet forum, help files and the esp@cenet assistant. Time will also be reserved for question and answers.

Hands-on Searching in esp@cenet

Building on a basic introduction to the service, students will learn how to access esp@cenet and then perform simple searches through examples to better understand the possibilities and limitations of the service.
esp@cenet will be introduced by means of a short presentation. This will be followed by some worked through examples to show how to access the service and perform searches. A series of practical exercises each demonstrating particular functions of the service will then be set for the students to practice (hands on) using esp@cenet for themselves.

Intellectual property on the internet

There are a number of intellectual property resources available on the internet. This course is an introduction to the various types of intellectual property, how to find out the status, ownership and substance of different IP rights, internet resources supporting the different aspects of IP management: registration, protection , exploitation and so on, will be explored. Course participants will have the opportunity of exploring IP space on the internet for themselves.

Overview on patent information products for business use

This course will provide an overview on how to use patent information to support decision making in the business environment. The role of patent information with regard to identifying the best patent strategy and managing patent portfolios will be explained. It will be illustrated how statistic analyses of bibliographic data can help to assess competitors' filing activities and emerging technological trends. An illustration of IP score, a tool for analysing own patent portfolios, will clarify how to identify opportunities and risks and align the patent strategy with the overall business strategy.

Looking East - the EPO's East Asian patent information services

Recent patent statistics illustrate a tremendous growth in patent filings in East Asian countries, most notably China and Korea, in addition to Japan, which has been a force to be reckoned with for many years. These are important developments affecting patent searchers' daily work.
This presentation will give you an insight into patenting and patent trends in Japan, China and Korea, and introduce the most important aspects of their patent systems. You will also learn what the EPO can do to help you get "fit for Asia".

Electronic Publications from the EPO

This presentation will provide an introduction into the information contained in the ESPACE databases and the Publication server. Participants will also be introduced to some of the basic functionality offered by the MIMOSA retrieving software.

Register Plus and WebRegMT

This workshop is an introduction to the EPO's Register Plus and it's alert service. You will learn how to retrieve data and view files and moreover, how to set alerts for your specific requirements. The workshop will also concentrate on how to interpret the information delivered via these products.

Register Plus: is the EPO's legal and procedural status database. Users can retrieve information on applications during the European phase, moreover via the online file inspection, users can obtain the procedural correspondence between the EPO and it's clients. Via the standard and advanced search functions, both novice and more expert users can optimally extract data and information from the register.

WebRegMT: is the EPO's register alert service. It notifies you when specific changes in selected files occur. Users can select which changes trigger a notification and can monitor up to 1000 cases per account.

Practical exercises

In this practical session, the participants will have the opportunity to practice the knowledge and skills acquired during the preceding days. Given exercises referring to the various EPO products and patent information sources introduced in the seminar shall, therefore, be solved in small groups.
