Peculiarities in the patent systems of EPC member states and the USPTO

This lesson explains the unique aspects of the national patent procedures of some selected EPC member states and compares them with the European patent procedure. Most national procedures have been harmonized into the European Patent Convention, but there remain some special features associated with national filings, grants and maintenance of patents. The countries taken as examples are AT, CH, FR, GB, IT and SE because they show a variety of specific features. The patent system of the USPTO, although largely harmonized with the PCT regulations, still shows some very specific features which have to be respected when seeking patent protection in the USA.

Classification

The European Classification (ECLA) and International Patent Classification (IPC) are indispensable for the retrieval of the most relevant patent documents in the search for "prior art" via the esp@cenet service. Such retrieval is needed by patent-issuing authorities to quickly identify and retrieve relevant patent publications and non patent literature documents collectively prior art.  Having access to relevant publications will as such enable the examiner to make a balanced decision on whether or not to grant a patent.   But also potential inventors, research and development units, students and others concerned with the application or development of technology can make use of the classifications to retrieve relevant publications.  This training module will explain IPC and ECLA. We will show you how to efficiently use IPC and ECLA to narrow down your search and retrieve the most relevant documents. The aspects of the latest IPC, core level, advanced level, applied to invention information and additional information will be described in detail. Also the use of IPC in combination with ECLA will be explained. 

Get the most out of the EPO's free online patent information products

The EPO provides a number of online patent information products which together form an integrated package of patent information retrieval tools:

esp@cenet : is the most widely known patent information resource on the internet, provides access to more than 60 million documents via a user friendly interface. Novices can use the basic functions to retrieve state of the art information, more experienced users can use the advanced features to retrieve a more refined search result.

Register Plus: is the EPO's legal and procedural status database. Users can retrieve information on applications during the European phase, moreover via the online file inspection, users can obtain the procedural correspondence between the EPO and it's clients. Via the standard and advanced search functions, both novice and more expert users can optimally extract data and information from the register.

WebRegMT: is the EPO's register alert service. It notifies you when specific changes in selected files occur. Users can select which changes trigger a notification and can monitor up to 1000 cases per account.

This workshop will demonstrate how to use these three products together to gain a comprehensive overview of the patent landscape. Participants for this advanced workshop will have preferably attended one of our EPIBS Beginners seminars.

Worldwide patent family and legal status information on esp@cenet® and the OPS

This course illustrates the key features of the extended patent family and the worldwide legal status data (INPADOC) available on the esp@cenet and OPS systems. Starting with an historic overview it will introduce the concept of patent family and its application in the EPO databases. A detailed illustration of the worldwide legal status data will follow, with dedicated attention to the issues of the nationalisation of regional and international patent applications ("national phase").
The different implementation concepts used by the EPO internally (Open Patent Services, esp@cenet) and by commercial providers will be shown and the EPO databases (INPADOC) mini-site will be accessed via the EPO homepage. To better understand the usefulness of the worldwide patent family and legal status databases some strengths and stumbling blocks will be elaborated. Additionally, information will be given on who delivers what kind and what amount of data to the database.

Fit for Asia - your stepping stone to patent information from Japan, China and Korea

Patent information from East Asia has traditionally been difficult to access and interpret. Yet, in an increasingly global economy, nobody can afford to neglect patent documentation from Japan, China or Korea.
This course will help you understand the essentials of East Asian patent documentation. It will uncover the mysteries of the numbering systems and explain country-related specifics such as the Japanese imperial years. You will learn to distinguish different types of documents, and get practical tips on how to read and interpret the information found on the first pages of Japanese, Chinese and Korean documents. In addition, this course will give you a detailed overview of available sources and databases and discuss aspects such as data coverage, year coverage, time delay and technical requirements, with special emphasis on practical search tips.
 

Get professional with ESPACE databases and MIMOSA retrieval software

ESPACE databases can now be accessed locally, through the intranet or the internet. It provides a low cost and easy means of accessing patent information and maintaining an on-site archive. You can carry out complex and confidential searches using the MIMOSA software and the output can be customised according to your needs. The session will provide an overview of the various ESPACE series available and some highlights of the MIMOSA retrieval software. By the end of the session you should have an understanding of which ESPACE collections best meet the needs of your organisation as well as some ideas on how best to use ESPACE products to disseminate the information retrieved.
 

Patent statistics for business use

This course will provide an overview on the compilation and use of patent statistics. It will be illustrated how statistical analyses of bibliographic data can help to assess competitors' filing activities and emerging technological trends. The participants will create own statistical analyses and visualize them with standard office tools. Pitfalls in interpreting statistics will be highlighted and it will be shown how patent information can influence the decision making process.
