Under the European Patent Convention, the Boards of Appeal of the European Patent Office have final-instance jurisdiction with respect to European patents.
A board of appeal acts in a collegial manner, in that context a board member's main duties are as follows:
Candidates must have a diploma of completed law studies at university level or - in exceptional cases - equivalent knowledge acquired over many years of qualified work, as well as many years of professional experience.
They must also have a special aptitude for judicial work. Very high standards of performance are expected. Candidates should have worked as judges, preferably in the field of patent law, and/or have practical experience in patent opposition, appeal, nullity, infringement proceedings as lawyers in private practice, or as legal advisers in public administration or industry. They should preferably be between 45 and 55 years of age.
Candidates must have an excellent knowledge of one official language of the EPO (English, French and German) and the ability to understand the other two.
Internal candidates should supplement their application with their last two full period staff reports, as well as agree to their superior being contacted in case they are invited for an interview.
