Building work

   The European Patent Organisation is an intergovernmental organisation set up pursuant to the European Patent Convention, which entered into force in 1977. It now has 34 member states (Austria, Belgium, Bulgaria, Croatia, Cyprus, Czech Republic, Denmark, Estonia, Finland, France, Germany, Greece, Hungary, Iceland, Ireland, Italy, Latvia, Liechtenstein, Lithuania, Luxembourg, Malta, Monaco, Netherlands, Norway, Poland, Portugal, Romania, Slovakia, Slovenia, Spain, Sweden, Switzerland, Turkey and United Kingdom). The executive body of the EPO is the European Patent Office, which is charged with the searching and examination of European patent applications and the granting of European patents. It employs approximately 6 700 staff at EPO headquarters in Munich, a branch at The Hague (NL-Rijswijk) and sub-offices in Berlin and Vienna (the number of member states and staff members is subject to change).

3. Description of the contract:

   1. Purpose of contract:

      Building work
      
      Work: Decontamination

      Site facilities

      • general site set-up, incl. portable recreational and storage rooms

      Period: November 2008 to October 2010

      Scaffolding equipment

      • erection, operation and moving of passenger lift and material hoist (2)
      • erection, maintenance and dismantling of a scaffold tower (1)

      Period: November 2008 to September 2010
      
      Safety measures

      • set-up, marking and maintenance of sealed-off areas for decontamination work and disposal of asbestos (incl. recreational areas, electricity, water, waste-water drainage) (18 areas)
      • sealing-off of staircases (4)
      • sealing-off of walls (approx 5 400 m²)
      • sealing-off of windows (approx 9 900 m²)
      • removal of wall components (approx 18 000 m²)
      • installation and maintenance of airlocks for staff and equipment
      • installation and maintenance of required technical equipment and emissions apparatus

      Period: November 2008 to September 2010

      Removal of dangerous substances (German Technical Rules on Dangerous Substances ("TRGS") Nos. 519 and 521)

      • safe and non-destructive extraction, packaging and removal through airlock of contaminated materials:
        ceilings, insulants and pipes containing mineral fibres, fire valves containing asbestos (approx. 600), asbestos cords (approx. 900 m), carpets (22 400 m²)
      • decontamination of ventilation-shaft interiors
      • decontamination, clean-up and residual-fibre encapsulation
      • disposal / recycling of contaminated materials

      Period: November 2008 to September 2010

   2. Division into lots:

      Not applicable

   3. Deposits and guarantees required:

      Performance bond amounting to 10% of the net contract sum
      Defects liability bond amounting to 5% of the net final-invoice amount

   4. Main terms concerning payment:

      Subject to Part B of the Building Contract Code ("VOB/B") (payment period for instalments 18 working days / final invoice 30 working days)

5. Variants:

   The elements and the planned performance of any work concerned by proposed variants must be described in the bid in a comprehensive and verifiable manner. Variants and supplementary bids may be submitted only with a main bid.

      The EPO does not expect to send the Procurement Documents before early June 2008 and would therefore ask bidders to refrain from requesting clarification before then.

   Seven months as from final date for submitting bids as per point 6(d) above

10. Criteria for the award of contract:

    Criteria group I: Economic efficiency (weighting 70%)

    • Price

    Criteria group II: Competence / capacity (weighting 30%)

    • In-house performance of services
    • Managerial and operational staff
    • References relating to the provision of similar services in the last three financial years
    • Technical equipment available for performance of the services
    • Planned on-site deployment of staff, with breakdown according to function
    • Turnover in the last three financial years
    • Any pending legal proceedings
    • Average number of staff employed in the last three financial years, with breakdown according to function

11. Other information:

    The EPO reserves the right to invite bidders to a meeting to clarify their bid. The costs incurred by bidders in attending such meetings are not reimbursable.
    It is planned to offer bidders an opportunity to visit the object on 12/13 June 2008 on prior arrangement of an appointment. Requests for an appointment must be sent in writing by post, fax or e mail to the address specified in Point 6(a) by 10 June 2008, 12:00 hrs. The request must quote the number of this tender and the full name(s) of the person(s) who will be attending on behalf of their firm. The EPO will inform bidders of the precise time of the visit.
    Contract award is expected to take place in the first week of November 2008.
