Design, engineering and construction of a new office accommodation on the EPO's premises in The Hague (Rijswijk), the Netherlands

  1. Awarding Authority:

    The European Patent Organisation (EPO) through the European Patent Office: Headquarters, Erhardtstrasse 27, D-80469 Munich.
    The European Patent Organisation is an intergovernmental organisation set up pursuant to the European Patent Convention which entered into force in 1977. At present it has 38 Member States (Albania, Austria, Belgium, Bulgaria, Croatia, Cyprus, the Czech Republic, Denmark, Estonia, Finland, Former Yugoslav Republic of Macedonia, France, Germany, Greece, Hungary, Iceland, Ireland, Italy, Latvia, Liechtenstein, Lithuania, Luxembourg, Malta, Monaco, Netherlands, Norway, Poland, Portugal, Romania, San Marino, Republic of Serbia, Slovakia, Slovenia, Spain, Sweden, Switzerland, Turkey and United Kingdom). The executive body of the EPO is the European Patent Office which is charged with the searching and examination of European patent applications and the granting of European patents. It employs approximately 6700 staff at EPO headquarters in Munich, a branch at The Hague/Rijswijk (NL) and sub-offices in Berlin and Vienna (the number of Member States and staff members indicated may change).

  2. Award procedure:

    Restricted two-stage invitation to tender with discretionary award of a Design and Construct contract preceded by an international open prequalification procedure.
    Resulting from the prequalification procedure, a maximum of ten Parties will be invited to participate in the tender and a maximum of three Parties, resulting from the first stage of the tender, will be admitted to the second stage of the tender.
    The first stage of the tender will be conducted anonymously and the second stage of the tender cooperatively.

  3. Description of the contract:

    1. Purpose of the contract:

      Design, engineering and construction of a new office accommodation on the EPO's premises in The Hague (Rijswijk), the Netherlands. The new office accommodation is to replace one of the EPO's existing office buildings and, in addition to house staff currently accommodated in leased buildings in the vicinity of the EPO premises in Rijswijk.

      The new office building will contain mainly offices (approx. 1.850 workplaces), meeting and training rooms, catering facilities (complement to the existing facilities) and ancillary rooms. As a reference, the overall extent of the building is expected to be approx. 70.000 sq.m. Gross Floor Area (GFA).

      The new building and its construction shall be organised in such a way that no decant accommodation shall be needed during the realisation period: the complete site and existing buildings shall remain fully operational during the entire process. The existing Main building shall be demolished only after relocating staff into the new office building.

      Under the realm of the Design and Construct contract the Contractor (party that is awarded the contract) is expected globally to perform:

      • the architectural design of the new office building
      • the technical design and engineering of the new office building
      • the construction of the new office building
      • the demolition of the existing Rijswijk Main building (approx. 60.000 sq.m.)
      • the completion of the site including landscaping (according to the design and comprising the footprint of the demolished building)
      • quality and safety assurance
    2. Division into lots:

    3. Any deposits and guarantees required:

      A bank guarantee equal to 10% (ten percent) of the contract value shall be required. The bank guarantee shall enter into force upon signature of the Design and Construct Contract and expire after completion and acceptance.

    4. Main terms concerning payment:

      Payments will be made in instalments according to an agreed payment scheme following the progress of the works.

    5. Qualifications required by law:

      The Contractor must be eligible for permits issued by the local authorities in order to carry out the works.

      Based on the current provisional time schedule, the Design and Construct Contract is expected to be awarded in April 2013 and the following indicative milestones apply:

      • April 2013 award of contract
      • March 2016 delivery of the new building
      • October 2016 completion of the project
  5. Variants:

    Proposals for variants, the effect of which would be to reduce significantly the rights and safeguards of the EPO, are not allowed.

      Based on the assessment, the Applications will be ranked and up to the first ten will be invited to participate in the tender.

  7. Tender documents and bids 1st stage:

    1. Participation in the tender procedure; dispatch of Procurement Documents:

      A maximum of ten Applicants are eligible for the Invitation to Tender. The Procurement Documents will only be made available to the Applicants invited by the EPO.
      Invitation to Tender is provisionally scheduled for April 2012.

    2. Language in which bids and requests for clarification of the Procurements Documents must be drawn up:

      English; the Procurement Documents will be available in English only.
      Bids and requests for clarification shall be submitted in English.

    3. Final date for receipt by the EPO for requests for clarification of the Procurement Documents:

      This is provisionally scheduled for May 2012. The exact date will be communicated to the participating Bidders together with the Procurement Documents.

    4. Final date for receipt of bids:

      This is provisionally scheduled for June 2012. The exact date will be communicated to the participating Bidders together with the Procurement Documents..

      Requests for clarification may be submitted through SharePoint.
      Bids shall be submitted by regular mail to the address mentioned under 6(e) and - as the case may be upon request of the EPO or together with the bid - through Sharepoint.
      Bids submitted by fax or e-mail will be excluded.

  8.  Tender documents and bids 2nd stage:

    1. Participation in the stage tender procedure; dispatch of conditions of tender:

      A maximum of three Bidders are eligible for invitation. The conditions of tender will only be accessible to those Bidders.
      This is provisionally scheduled for the middle of August 2012.

    2. Language in which bids and requests for clarification of the conditions of tender must written:

      English; the Procurement Documents will only be available in English.

    3. Deadline for receiving requests for clarification of the conditions of tender:

  9. Legal form of the Contractor:

    The EPO intends to conclude only one contract with one Contractor being one legal entity having a seat in one of the EPO member states.

    If several bidders submit a joint bid, one must be designated as Main Contractor responsible for performance of all the obligations under the contract. Members of that group shall be jointly and severally liable.

    The Contractor may be a Consortium or as a Main Contractor with subcontractors. A combination of both, a Consortium complemented with subcontractors is also allowed. The Applicant should comprise at least a construction company, an international renowned architect and an engineering team (consulting engineers).

  10. Period during which the bidder is bound by his bid:

    Nine months as from the final date of receipt indicated in point 8(d)

  11. Other information:

    An individual site visit will only be organised as part of the 1st stage of the tender.
    The 2nd stage will be cooperative through organising one clarification meeting and two workshops with each of the individual bidders to discuss the development of their respective designs. These will be organised at the EPO premises in Rijswijk, The Netherlands.

    Main terms concerning payment for participating in the tender:
    For participating in the pre-qualification and the first stage no financial compensation will be granted..
    Unsuccessful bidders in the second stage of the tender, submitting a bid in compliance with the Tender Conditions, will receive a financial compensation.
