Design, supply and installation of a fall protection system for rooftop maintenance and ancillary works.

  1. Awarding Authority:

    The European Patent Organisation (EPO) through the European Patent Office: Headquarters, Erhardtstrasse 27, D-80469 Munich, Postal address: EPO, D-80298 Munich.

    The European Patent Organisation is an intergovernmental organisation set up pursuant to the European Patent Convention which entered into force in 1977. At present it has 32 Member States (Austria, Belgium, Bulgaria, Cyprus, the Czech Republic, Denmark, Ellas, Estonia, Finland, France, Germany, Hungary, Iceland, Ireland, Italy, Latvia, Liechtenstein, Lithuania, Luxembourg, Malta, Monaco, Netherlands, Poland, Portugal, Romania, Slovakia, Slovenia, Spain, Sweden, Switzerland, Turkey and United Kingdom). The executive body of the EPO is the European Patent Office which is charged with the searching and examination of European patent applications and the granting of European patents. It employs approximately 6700 staff at EPO headquarters in Munich, a branch at The Hague/Rijswijk (NL) and sub-offices in Berlin and Vienna (the number of Member States and staff members indicated may change).

  2. Award procedure:

    Open international invitation to tender with discretionary award of contract.

  3. Description of contract:

    1. Purpose of the contract:

      Design, supply and installation of a fall protection system for rooftop maintenance and ancillary works.

    2. Division into lots:

      Not applicable.

    3. Any deposits and guarantees required:

      A bank guarantee equal to 5% of the price of the works shall be provided by the contractor to the EPO at the latest upon the date of the commencement of the works.
      The bank guarantee shall expire at the end of the liability for defects period.

    4. Main terms concerning payment:

      Payments will be made in instalments on the basis of work completed and accepted.

    5. Qualifications required by law:

      The contractor must be eligible for a permit to carry out the works from the local authorities.

    2. Duration of contract:

      The Works shall commence immediately following signature of the Agreement by both parties and all the Works shall be completed and accepted 4 months following signature of the Agreement.

  5. Variants:

    Proposals for variants, the effect of which would be to reduce significantly the rights and safeguards of the EPO, are not allowed.

    2. Final date for receipt by the EPO of requests for the Procurement Documents:

      11 September 2007 ,12:00 hrs. CET.

    3. Final date for receipt by the EPO of requests for clarification:

      24 September 2007 ,13:00 hrs. CET.
      Questions must be submitted by letter or fax.

    4. Final date for receipt bids/number of copies to be sent:

      10 October 2007,12:00 hrs. CET.
      Two copies, in addition to the original bid to be marked as such.

    5. Address to which the requests for clarification and bids must be sent:

      See point 6(a).

    6. Language or languages in which requests for clarification and bids must be drawn up:

      English, German or French.
      The Procurement Documents will only be available in English.

  7. Legal form of the grouping in the event of a joint bid:

    If several bidders submit a joint bid, one must be designated as prime contractor responsible for performance of all the obligations under the contract.

  8. Information and evidence concerning the bidder's financial and economic standing and technical and professional competence:

  9. Period for which the bidder is bound by his bid:

    Six months as from the final date for receipt of bids in point 6(d).

  10. Criteria for award of contract

    The contract shall be awarded to the bidder whose bid is to be preferred having regard to the bidder's:

    • proposed building team e.g. the deployment of subcontractors;
    • experience with similar projects;
    • compliance with the provisions of the Procurement Documents;
    • organisational ability;
    • presentation of the bid;
    • price in relation to the offered Works.
    • the contract sum shall not exceed 30% of the annual bidder's turnover of the previous 3 years.
  11. Other information

    The EPO reserves the right to visit the bidder's premises during the evaluation of the bids.

  12. Miscellaneous

    Contract award is expected to take place in the fourth quarter of 2007.
    A bidder's information meeting will be held at the European Patent Office in Rijswijk. The date and time will be announced in the letter of invitation to tender.
