Guide for applicants, Part 2: PCT procedure before the EPO (Euro-PCT Guide)

Patent Prosecution Highway (PPH) based on a WO-ISA established by the EPO as ISA
The PPH enables applicants whose claims have been determined to be patentable/allowable to have a corresponding application that has been filed with a PPH partner office processed in an accelerated manner while at the same time allowing the offices involved to exploit available work results.

Under the PCT-PPH pilot programme a PPH request can be based on the latest PCT work product, i.e. the WO-ISA or the IPER. Where the EPO is the ISA (and/or IPEA) and the international application contains claims that are determined to be patentable/allowable by the EPO as ISA (and/or IPEA), the applicant may under the PCT-PPH pilot programme request accelerated examination at the JPO and the USPTO when the application has entered the national phase before these offices.
The procedures and requirements for filing a request with the JPO and the USPTO for participation in the PCT-PPH pilot programme on the basis of a WO-ISA or IPER established by the EPO are available from the JPO and USPTO websites[ 24 ]. The pilot programme runs until 28 January 2014. A revised PCT-PPH pilot programme will start in early 2014. More information will be published in the Official Journal.
Irrespective of the PPH pilot programme any applicant may request accelerated examination under the PACE programme in the procedure before the EPO as designated Office at any time. For more information on the PACE programme reference is made to points 447 ff.
