Guide for applicants, Part 2: PCT procedure before the EPO (Euro-PCT Guide)

If the Euro-PCT application has entered the European phase, one or more European divisional applications may be filed in respect of subject-matter contained in a Euro-PCT application. If the applicant has filed a request for early processing, a divisional may be filed as from the date that request is effective (see point 433). The divisional application must be filed in the language of the proceedings of the earlier application. If the earlier application was not filed in an official language of the EPO, the divisional application may be filed in the language of the earlier application, and a translation into the language of the proceedings for the earlier application must be filed within two months of the filing of the divisional application.
