Headnote

Documents introduced for the first time in appeal proceedings following opposition must be taken into consideration when the principle of examination by the EPO of its own motion so requires. Where this is the case it may be appropriate to refer the matter back to the Opposition Division so as to make it possible for the new documents to be examined at two levels of jurisdiction and to avoid one of these being bypassed.

ORDER

For these reasons, it is decided that:

1. The impugned decision is set aside.

2. The case is referred back to the Opposition Division for consideration of the opposition to be resumed, with particular attention being paid to the new citation (3) filed with the statement of grounds on 20 November 1984.
