ORDER
For these reasons it is decided that:
1. The decision under appeal is set aside.
2. The case is remitted to the first instance with the order to grant the patent on the basis of:
- claim 1 presented at the oral proceedings;
- claims 2 to 11, description and drawings as set out by the first instance in its communication under Rule 51(4) EPC dated 4 December 1997.
