Decision of the Administrative Council of 25 October 2007 dispensing with the supplementary European search where the international search report was drawn up by the European Patent Office and reducing the fee for the supplementary European search where the international search report was drawn up by the Austrian Patent Office, the National Board of Patents and Registration of Finland, the Spanish Patent and Trademark Office, the Swedish Patent and Registration Office or the Nordic Patent Institute (CA/D 41/07)
THE ADMINISTRATIVE COUNCIL OF THE EUROPEAN PATENT ORGANISATION,
Having regard to the European Patent Convention and in particular Article 153, paragraph 7, EPC 2000, thereof,
On a proposal from the President of the European Patent Office,
Having regard to the opinion of the Budget and Finance Committee,
HAS DECIDED AS FOLLOWS:
Article 1
A supplementary European search report shall not be drawn up for international applications in respect of which an international search report has been drawn up by the European Patent Office.
Article 2
The fee for a supplementary European search on an international application for which the international search report was drawn up by the Austrian Patent Office, or in accordance with the Protocol on Centralisation, by the National Board of Patents and Registration of Finland, the Spanish Patent and Trademark Office, the Swedish Patent and Registration Office or the Nordic Patent Institute shall be reduced by EUR 845.
Article 3
This decision shall enter into force on 1 April 2008 and shall apply to international applications which are filed up to and including 30 June 2013, for which the international search report was drawn up by the Austrian Patent Office, the National Board of Patents and Registration of Finland, the Spanish Patent and Trademark Office, the Swedish Patent and Registration Office or the Nordic Patent Institute, and where the fee for a supplementary European search is paid on or after 1 April 2008.
Article 4
The decisions of 10 June 2005 (OJ EPO 7/2005, 415), of 27 October 2005 (OJ EPO 11/2005, 454) and of 15 December 2005 (OJ EPO 1/2006, 13) shall be rescinded as from 1 April 2008 and replaced by this decision.
