A supplementary European search is performed

In the following cases no dispensation applies and the EPO will draw up a supplementary European search report on entry into the European phase:

Art. 157(3)(b) EPC
OJ 1979, 368

OJ 1981, 5

OJ 1994, 6, 691

OJ 2000, 321

OJ 2005, 5, 422, 435




·

for any international application filed on or after 1 April 2005 for which the international search was performed by the Finnish patent office;



·

for any international application filed on or after 1 July 2005 for which the international search was performed by the Austrian, Spanish or Swedish patent office;



·

for any international application for which the international search was performed by any ISA not located in an EPC contracting state. At present these ISAs are the patent offices of Australia, Canada, China, Japan, the Russian Federation, the Republic of Korea and the USA.
