China: SIPO has revised Examination Guidelines to include design protection of GUI

According to an official notice which was published on the State Intellectual Property Office's (SIPO) Chinese website on 12 March 2014, several sections of the Examination Guidelines have been revised. The amendments concern the design protection of graphical user interfaces (GUI). Protection for GUI, including dynamic GUI, has now become possible under the Chinese legislation.

Display images such as electronic screen wallpapers or start-up and shut-down screens which are not related to game interfaces, human-computer interaction or the achievement of a device's functions remain excluded from design protection.

The sections of the Guidelines which have been amended are: Part 1, Chapter 3, Articles 4.2 and 4.3, 7.2, 7.4 and Part 4, Chapter 5, 6.1. The revised Guidelines will become effective on 1 May 2014.
