China: specialised IP courts to be established

According to a press release issued by the National People's Congress of China, the legislation regarding the establishment of specialised intellectual property courts was passed on 31 August 2014. (See also this earlier update). These IP courts will be established in Beijing, Shanghai and Guangzhou.

The courts will hear those administrative and civil IP cases relating to patents, plant varieties, layout designs of integrated circuits, technical secrets etc., which are more specialised and technically complex, in the first instance. First instance appeals against decisions taken by SIPO will be heard by the Beijing IP court. A decision taken by an IP court can be further appealed at the high court based in the city where the IP court is located.
