ASEAN: recent developments of the patent system in Brunei Darussalam

On 1 January 2012, the "Patent Registry Office" (PRO), administered under the (Brunei Economic Development Board (BEDB), commenced its operation. This also marks the effective date of the Patents Order 2011 and Patents Rules 2012. Brunei's Patent Order 2011 replaces the previous re-registration system of Singapore, Malaysia, UK and EP (designating UK) patents and establishes an independent patent system. These developments provided the grounds for the country's recent accession to the PCT which will enter into force in Brunei on 24 July 2012.

The first patent application was filed at the PRO on 4 January 2012. According to a press release on the PRO website, a full-fledged intellectual property office in charge of all IP rights may be established in the year 2013.

The Patents Order 2011 and Patents Rules 2012 can be downloaded as PDF documents from the "Legislation" section of the PRO website.
