With the implementation of the amended Trademark Act, the Intellectual Property Office (TIPO) will allow the registration of more non-traditional trade marks, including holograms, motions and scents from 1 July 2012 onwards. The applicant will have to provide proof to the office that these trade marks are recognised by local customers. The registration of trade marks which used a single colour, sound or 3D image has been possible since 1993.
Examples of such new trade marks can be found in a PDF document on TIPO's Chinese website.
The amended Trademark Act is available on TIPO's website (currently in Chinese only). Previous versions of the Trademark Act, its Enforcement Rules, a fee schedule and other related documents can be retrieved from the "Trademarks" section on TIPO's English website.
