China: Draft regulations for service inventions published for comment

On 12 November 2012, the Chinese Patent Office (SIPO) released a draft version of regulations for service inventions for public opinion. A service invention is an invention made by an employee of a company/entity in the performance of his duties. In such cases, the right to apply for a patent belongs to the company, which will also be the patent holder after grant. The draft contains regulations on awards and remuneration for employees, exploitation of IP rights originating from service inventions and measures on how the implementation of the regulations should be supervised.
