China: Amendments to "Regulations on Computer Software Protection"

On 1 March 2013, an amended version of the regulation on "Computer Software Protection" will enter into force. The amendment concerns Article 24 which relates to the amount of fines. For reproduction and distribution, a minimum charge of "no less than one time the value of the product" has been introduced. For other crimes, the maximum fine of RMB 50 000 has been raised to RMB 200 000.

On the same day, amendments to the provisions on determining the amount of fines will also enter into force for three other national regulations, namely the "Implementation of the Copyright Law", the "Protection of the Right to Network Dissemination of Information" and the "Protection of New Varieties of Plants".
