The National Assembly of Korea passed an amendment of the Korean Invention Promotion Act which will come into force on 31 January 2014. The amendment includes a number of provisions which will expand the protection of inventions made by employees. For example, an employer will no longer be automatically entitled to a royalty free non- exclusive license for inventions created by their employees as part of their business duties. According to the amendment, employers can only obtain this license if the employee agrees to assign the in-service inventions to the employer in advance, against payment of an appropriate compensation.
