Korea: Speedy non-substantive examination system for designs further extended

The Korean Intellectual Property Office (KIPO) has further enlarged the scope of design applications which fall under the "Non-Substantive Examination System" (NSES). The NSES covers mostly fashion-related items with a short life cycle such as clothing, shoes or jewelery. They are exempt from substantial examination and thus can be registered much faster than other designs.

Since January 2011, KIPO has initiated various measures to further promote this speedy registration system:

  • the number of design categories qualifying for the NSES have been extended from previously ten to twenty.
  • the average period from filing to registration for NSES-applications dropped considerably from 1.7 to 1.0 months (compared to around nine months for designs undergoing substantial examination).
