India: details of patented drugs to be made public

The Indian Patent Office (IPO) plans to publish information on the working status of patented drugs on its website. This information will include whether domestic demand is met at a reasonable price.

Patent holders are required to submit an annual statement to the IPO as to the "working of the patented invention on commercial scale in India" (Form 27). The statement has to include information on the quantity and value of the patented product and on whether public requirements have been met adequately at a reasonable price. It is at the IPO's discretion whether they make this information publicly available.

Increasing transparency on the working status of pharmaceutical product patents is considered critical in meeting domestic demand and ensuring the availability of medicines.
