The legislative branch of the government ("Legislative Yuan") passed the draft amendments to the Taiwan Patent Act on 29 November 2011. The new version of the law, which was last revised in 2003, will introduce a number of changes to the Taiwanese patent system.
The changes concern, among other things, the grace period for disclosure of an invention, the reinstatement of rights, divisional applications, patent term extensions, compulsory licenses, design protection, patent invalidation and the calculation of damages. In the amended law, provisions for dual filing of patent and utility models will also be included. The date on which the amended Patent Act will enter into force is still to be decided.
