Description

Experienced patent attorneys are conversant with the patent granting process laid down in the EPC and described in the EPO Guidelines for Examination. But what about how these texts are implemented by EPO examiners on a day-to-day basis? How does a division reach a consensus on proposing a patent grant or, conversely, refusing a patent application? What do patent examiners discuss during the breaks in oral proceedings in opposition? How do members of the Board of Appeal review decisions of the first-instance departments?

This understanding will enable you to better anticipate reactions of the division or the board and will help you better prepare your application, replies, opposition and/or appeal.

This course takes specific examples as a basis for discussing the practical application of the legal texts by EPO staff in their daily work. Participants will have the opportunity to experience what the work of an examiner or a member of the Board of Appeal looks like, based on exercises, such as drafting a written opinion in search, evaluation amendments in examination, elaborating summons in opposition, and drafting a communication in appeal, among others.

The course is aimed at patent attorneys with several years of experience. The workshop is not open to EQE candidates.

The work involved in participating in this course corresponds to 25 hours, spread over 4 weeks, that you can perform at your own pace.

Objectives

After the course, you will have a better understanding on how examiners and members of the Board of Appeal work on a day-to-day basis and how they deal with particular issues. This understanding will enable you to better anticipate reactions of the division or the board and will help you better prepare your application, replies, opposition and/or appeal.

Programme

Week 1: 08 – 12 November 2021 - Behind the scene – Search

o   Covering aspects such as drafting a written opinion issued by the search division (novelty, inventive step, clarity), consultation at search stage.

·        Interact with tutors and other participants in the forum

 

Week 2: 15 – 19 November 2021 - Behind the scene – Examination

o   Covering aspects such as evaluation of article 123(2) EPC, factors used by examination divisions to decide on the next appropriate action, details on grants

 

Week 3: 22 – 26 November - Behind the scene – Opposition

o   Covering aspects such as deciding on best suitable action as member of an opposition division; drafting the chosen action (communication, summons, direct decision)

 

Week 4: 28 November – 03 December - Behind the scene - Appeal

o   Covering aspects such as drafting a communication to be sent to the parties in preparation for an oral proceedings

Prerequisites

You will receive a full set of materials at the opening of the course and you will be able to study it at your own pace, with a forum and live sessions to interact with tutors and other participants. We likewise recommend to note down the dates in your calendar (please see under "Programme"), as it is not possible to offer alternative dates.
