For these reasons it is decided that:
1. The decision under appeal is set aside.
2. The communication noting of loss of rights pursuant to Rule 112(1) EPC of 10 January 2024 is set aside and the application EP XX XXX XXX.X filed on 29 November 2023 is processed as a divisional application.
3. The appeal fee is reimbursed.
