Patent litigation in Europe: UPC – One year in practice – from the litigator’s perspective
This advanced lecture series is dedicated to examining current topics in patent litigation in Europe, including the launch of the UPC and the emergence of new European patent jurisprudence. The series feeds the content of and leads up to the annual Litigation Matters conference. Participants can attend each session separately or the entire series. It is organised by the EPO in co-operation with the European Patent Lawyers Association (EPLAW) and the European Patent Litigators Association (EPLIT) .
This third lecture, entitled “One year in practice – from the litigator’s perspective,” is held by Marie-Ange Pozzo di Borgo, Oscar Lamme, and Oliver Jan Jüngst. It will be followed by a Q&A session.
One year after the historic opening of the UPC, our 3 speakers will delve into case law developments and emerging procedural trends shaping up the new patent court. In this webinar, you will get a litigator firsthand experience on aspects from bringing a case from filing through trial in the UPC system.

Marie-Ange Pozzo di Borgo
Admitted to the New York and Paris Bars, and a Solicitor of the Senior Courts of England and Wales, Marie-Ange Pozzo di Borgo is a member of Gide's Intellectual Property practice group since 2013. She advises French and international clients on industrial property matters (patents, trademarks and designs), as well as copyrights and unfair competition.
She has a strong focus on patent disputes. Her recent experience includes advising clients in the pharmaceutical and aeronautic industries on multi-jurisdictional cases, involving patent or SPC invalidity and/or infringement claims, preliminary injunction and saisie-contrefaçon preparation, product clearances, and regulatory issues.
Marie-Ange holds an LL.M. from UCLA in Entertainment, Media Law and Policy, a Master degree in Applied Intellectual Property from Paris XII, and a Master degree in Corporate Law and Management from Paris II – Panthéon-Assas University. She has also studied at Università Luigi Bocconi in Milan.
Oscar Lamme
Oscar is a partner in the IP practice in the Netherlands. He has over 15 years experience and specialises in international patent and trade secret litigation, tech licensing and other technology-related matters. Having a background in engineering, Oscar is well placed to represent a wide variety of multinational clients active in telecom, electronics, biotechnology and the pharmaceutical industry. His cases are mostly cross-jurisdictional and he often works on the convergence of different areas of law, such as patent law and competition law.
Oscar regularly publishes on patent law topics, such as the Unified Patent Court and the Unitary Patent, and frequently speaks at national and international congresses.
Oliver Jan Jüngst
Oliver has been with Bird & Bird LLP since the opening of the first German office in Düsseldorf in 2002. Oliver has 25 years' history of litigating patents on both sides of the ”v.”
His special area of expertise is the organisation and implementation of international patent infringement litigation. Oliver handles patent cases before all German Courts, the European Patent Office as well as the Unified Patent Court. He has run several of the largest patent cases in Germany and appeared in the first-ever substantive hearings before the UPC for NanoString Technologies Inc., in the Munich Local Division and the Court of Appeal in Luxembourg, respectively.
