Mastering exclusions from and exceptions to patentability
Participants will be confronted with various situations where the non-patentability of a claim needs a detailed assessment. After a general review of the legal provisions of the EPC, participants will be split into groups to review particular cases that are specific to technical fields, in particular:
- how to assess the technical effect of a feature for a computer-implemented invention (first hurdle). Examples will be discussed from various technical sub-fields (business methods, POI/GUI, mathematics, game rules)
- non-patentable biotechnological inventions and methods of treatment of the human body
An insight into rights for IP other than patents will also be given (traditional knowledge, the UPOV Convention). The workshop consists of two online sessions and active study of learning materials.
