I am prepared to allow any person to use the invention as a licensee in return for appropriate consideration. How should I proceed?

Statement on licences of right  

Unitary Patent proprietors can file a statement with the EPO to the effect that they are prepared to allow any person to use their invention as a licensee in return for appropriate consideration (licence of right). We recommend using EPO Form 7001 to a file a statement of intention to license in this way. The statement will be registered in the Register for unitary patent protection free of charge.  

Any licence under this scheme will be a contractual licence on terms agreed between the proprietor and the licensee (Article 8(1) Regulation (EU) No 1257/2012). The Unified Patent Court has exclusive competence in respect of actions for compensation for licences granted on the basis of this scheme (Article 32(1)(h) UPC Agreement). 

Reduced renewal fee 

Renewal fees for a Unitary Patent which fall due after receipt of a statement on licences of right under Rule 12(1) UPR will be reduced by 15%. Any additional fee for belated payment of a renewal fee will be calculated on the basis of the reduced renewal fee. 

Limitations 

If a statement on licences of right is already recorded in the Register for unitary patent protection, any subsequent request for recording of an exclusive licence in the Register will be inadmissible, unless the previous statement on licences of right is formally withdrawn. 

Likewise, if an exclusive licence is already recorded in the Register for unitary patent protection, or if a request for recording of an exclusive licence is pending before the EPO, a statement on licences of right cannot be registered. 

Withdrawal 

Unitary Patent proprietors may withdraw their statement on licences of right at any time by filing a communication to this effect with the EPO. We recommend using the dedicated EPO Form 7002 for this. However, the withdrawal will take effect only if the amount by which the renewal fees were reduced is paid to the EPO.
