On 1 April 2015, the State Intellectual Property Office of China (SIPO) released a draft version of the amended Chinese Patent Law for public opinion.
The aim of the amendments is mainly to enhance patent protection, inter alia by providing local IP offices with more authority in infringement cases, and by further clarifying fines and damages. The proposal includes a number of new regulations, e.g. concerning internet infringement and patent agencies. Within the framework of China's planned accession to the Hague Agreement, it is also foreseen to increase the duration of design rights to 15 years.
The draft is open for comment until 28 April 2015. More information, including a comparison table of the planned changes and the current provisions (in force since October 2009), is available on SIPO's website (Chinese only).
