On 1 March 2017, a comprehensive amendment of the Korean patent law will enter into force. Some of the most important new provisions are, among many others, the re-introduction of the post-grant opposition system (see separate news item) and the reduction of the period for filing the examination request from five to three years from filing day (see separate news item).
Even though these new stipulations have not yet entered into force, the Korean Intellectual Property Office (KIPO) already published a Korean version of the complete amended Patent Act. For each article, KIPO offers also a comparison of the new provision with the previous content.
While the text is difficult to access for most users due to the language barrier, the text can be copied into free online machine translation tools. Also, the EPO's team for Asian patent information published a search guide which shows you step by step how to access and to use this new version of the Korean Patent Act.
