China: New Administrative Measures for Prioritised Patent Examination in force

As announced in an earlier update, the State Intellectual Property Office of China (SIPO) has revised its Administrative Measures for Prioritised Patent Examination. The new measures entered into force as of 1 August 2017, replacing the previous measures which were issued five years ago.

Under the new measures, applicants may now request prioritised application not only for invention patent applications, but also for utility model and design applications. In addition, re-examination and invalidation procedures may also be expedited under certain conditions. In order to simplify the procedures for applicants, among other things, the number of documents required to request prioritised application has been reduced.
