As announced in an earlier Update, the Hong Kong patent system has recently been fundamentally revised. The new patent system will enter into force on 19 December 2019, according to a press release and notices in the gazette, published on 11 October 2019.
The new patent system introduces an "original grant patent (OGP) system" to provide applicants with an alternative route for standard patent protection in Hong Kong. Applicants will have the option of filing standard patent applications directly with the Hong Kong Intellectual Property Department (HKIPD). A prior filing of corresponding applications with a designated patent office outside Hong Kong - as required under the existing "re-registration" system - will no longer be required.
Furthermore, the new patent system refines the existing short term patent system, while still offering this cost-effective way of obtaining protection in Hong Kong.
