  • Unknown: may be displayed for EP patents designating Belgium that were granted before 22 September 2014; the online Belgian patent register should then be checked to see whether any status is displayed in its Additional Information section. If the EP patent has been surrendered/renounced, the status will be Renonciation / Verzaking. If it has not been validated, the status will be Sans effet (suite) / Zonder gevolg. If it has been annulled, the status will be Annulation / Nietigverklaring. No status will be displayed for a lapsed or expired EP patent but the lapse or expiry date will be shown in the Dates section. The online Belgian patent register can be viewed in English, French, German or Dutch.
  • Request for validation received: EP patent has been granted (B1, B2 or B3), but the national validation proceedings are still pending. For EP patents designating Belgium and granted (B1, B2 or B3) by the EPO in English before 1 January 2017, validation in Belgium was conditional on the filing of a translation into an official language of Belgium within three months of the publication date, but EP patents designating Belgium and granted (B1, B2 or B3) by the EPO in English, French or German since 1 January 2017 are automatically validated in Belgium without any validation procedure.
  • Patent surrendered: EP patent has been surrendered/renounced at the proprietor's request. Annual renewal fees may have been paid before the request for surrender/renunciation was filed.
  • Patent revoked: EP patent has been revoked at the proprietor's request or by decision of the EPO. Annual renewal fees may have been paid before the request was filed or the decision was taken.
  • Patent lapsed: EP patent has lapsed due to non-payment of an annual renewal fee.
  • Patent expired: EP patent has expired after 20 years from its filing date.
  • Patent validated: the national procedure for validation of the EP patent has been successfully completed, i.e. the EP patent is considered valid in Belgium. For EP patents designating Belgium and granted (B1, B2 or B3) by the EPO in English before 1 January 2017, validation in Belgium was conditional on the filing of a translation into an official language of Belgium within three months of the publication date, but EP patents designating Belgium and granted (B1, B2 or B3) by the EPO in English, French or German since 1 January 2017 are automatically validated in Belgium.

    If the first annual renewal fee due in Belgium after the grant of the EP patent has not yet been paid, the Renewal fees last paid field will be empty.
  • Patent not validated: the national procedure for validation of the EP patent has not been completed successfully, i.e. the EP patent is deemed void in Belgium.
  • Nullity requested: the EP patent has been annulled by court decision.

In the current version of the BE-FRS, the Invalidation date field will:

  • be empty if the EP patent has been surrendered/renounced, but the surrender/renunciation date can be found in the online Belgian patent register
  • display the revocation or annulment date shown in the online Belgian patent register if the EP patent has been revoked or annulled
  • be empty if the EP patent has lapsed
  • display the expiry date if the EP patent has expired (but may be empty if the EP patent was granted before 22 September 2014)
  • be empty if the EP patent has not been validated.

Not in force since

Date from which the rights conferred by the EP patent are no longer considered to be in force in Belgium.

 In the current version of the BE-FRS, the Not in force since field will:

  • be empty if the EP patent was surrendered/renounced before 22 September 2014 or display the total surrender/renunciation date if this happened after 22 September 2014. Total surrender/renunciation causes the patent to lapse as of the date of entry of the declaration in the Register. If, however, the annual renewal fee due to keep the patent in force has not yet been paid as at that date, it will instead lapse with effect from the end of the period covered by the last paid annual renewal fee.
  • display the filing date if the EP patent has been revoked (but may be empty if it was granted before 22 September 2014).
  • display the filing date if the EP patent has been annulled (but may be empty if it was granted before 22 September 2014).
  • display the lapse date if the EP patent has lapsed (but may be empty if it was granted before 22 September 2014).
  • display the expiry date if the EP patent has expired (but may be empty if it was granted before 22 September 2014).
  • display the filing date if the EP patent was never validated (but may be empty if it was granted before 22 September 2014).
