ENTSCHEIDUNGSFORMEL
Aus diesen Gründen wird entschieden:
1. Die angefochtene Entscheidung wird aufgehoben.
2. Die Sache wird zurückverwiesen an die erste Instanz zur Fortsetzung des Verfahrens auf der Basis des Hilfsantrags I, eingereicht als Hilfsantrag IV mit Schreiben vom 12. Juli 2007.
3. Der Antrag auf Rückzahlung der Beschwerdegebühr wird zurückgewiesen.
