Aus diesen Gründen wird entschieden:
1. Die angefochtene Entscheidung wird aufgehoben.
2. Die Sache wird an die erste Instanz zurückverwiesen mit der Auflage, das Patent auf Basis der Ansprüche 1 und 2 des in der mündlichen Verhandlung am 8. Juli 2010 eingereichten Hauptantrags und einer noch daran anzupassenden Beschreibung aufrecht zu erhalten.
