Entscheidungsformel
Aus diesen Gründen wird entschieden:
1. Die angefochtene Entscheidung wird aufgehoben.
2. Die Sache wird an die erste Instanz mit der Maßgabe zurückverwiesen, das Patent in folgendem Umfang aufrechtzuerhalten:
Patentansprüche 1 bis 18 in der Fassung des Hilfsantrags, eingereicht mit Schriftsatz vom 19. Januar 2010 nebst einer noch anzupassenden Beschreibung und anzupassenden Zeichnungen.
