Aus diesen Gründen wird entschieden:
1. Die angefochtene Entscheidung wird aufgehoben.
2. Die Angelegenheit wird an die erste Instanz zurückverwiesen mit der Anordnung, das Patent in der folgenden geänderten Fassung aufrechtzuerhalten:
