For these reasons, it is decided that:
1. The decision under appeal is set aside.
2. The case is remitted to the first instance with the order to maintain the European patent on the basis of thefollowing documents:
Claims 1 and 3 of the granted patent with Claim 3 renumbered 2 and appended to Claim 1 (instead of to Claims 1 and 2)
the description and Figure 1 of the drawings of the granted patent.
