Aus diesen Gründen wird entschieden:
1. Die angefochtene Entscheidung wird aufgehoben;
2. Der Hauptantrag und der erste Hilfsantrag werden zurückgewiesen;
3. Die Patentansprüche des 2. Hilfsantrags sind neu (Art. 54 EPÜ);
4. Die Angelegenheit wird an die erste Instanz zurückverwiesen mit der Auflage, die Patentansprüche des 2. Hilfsantrags auf alle weiteren Erfordernisse des EPÜ zu prüfen.
