4.4. Therefore, in the Board's judgement, claims 1 to 4 according to the auxiliary request meet the requirements of Article 52(1) EPC. ORDER
For these reasons it is decided that:
1. The decision under appeal is set aside.
2. The case is remitted to the department of the first instance with the order to grant the patent with the following documents:
- claims 1 to 4 according to the auxiliary request submitted at the oral proceedings;
