DECISION of the Administrative Council of the European Patent Organisation of 24 February 1978 amending the French version of Rule 85, paragraph 1, of the Implementing Regulations to the European Patent Convention
THE ADMINISTRATIVE COUNCIL OF THE EUROPEAN PATENT ORGANISATION, HAVING REGARD to the European Patent Convention (hereinafter referred to as "the Convention"), and in particular Article 33, paragraph 1 (b) thereof,
HAVING REGARD to the proposal from the President of the European Patent Office, WHEREAS in the event of divergences between the texts of a Rule in the three official languages of the European Patent Office it is necessary, in view of Article 177, paragraph 1, of the Convention, to amend the Implementing Regulations to the Convention (hereinafter referred to as "the Implementing Regulations"),
HAS ADOPTED THE FOLLOWING DECISION:
Article 1
The French version of Rule 85, paragraph 1, of the Implementing Regulations shall read as follows:
«Si un délai expire soit un jour où l'Office européen des brevets n'est pas ouvert pour recevoir le dépôt des pièces, soit un jour où le courrier normal n'est pas distribué dans la localité où cet Office est situé, pour des raisons autres que celles indiquées au paragraphe 2, le délai est prorogé jusqu'au premier jour suivant où l'Office européen des brevets est ouvert pour recevoir ce dépôt et où le courrier normal est distribué.»
Article 2
The President of the European Patent Office shall forward to all signatory States to the Convention and States acceding to the Convention a certified true copy of this Decision.
Article 3
This Decision shall enter into force on the date of its publication in the Official Journal of the European Patent Office.
