Application of Rule 38, paragraphs 3 and 4, EPC to European divisional applications filed under Article 76, EPC and to new European patent applications filed under Article 61, paragraph 1(b), EPC
There is no need to produce the copy of the previous application referred to in Rule 38, paragraph 3, EPC, nor the translation of the previous application referred to in Rule 38, paragraph 4, EPC, in the case of a European divisional application filed under Article 76, EPC or a new European patent application filed under Article 61, paragraph 1(b), EPC.
The EPO will make a copy of the document or documents in question which were furnished to support the initial application and will place them in the file of the divisional application or of the new application filed under Article 61, paragraph 1(b), EPC.
