Notice dated 12 December 1991 concerning the application of Legal Advice No. 5/80
Pursuant to the as yet unpublished Decision of the Legal Board of Appeal, J 4/91 of 22 October 1991, Legal Advice No. 5/80 (OJ EPO 1980, 149) is not applicable in respect of the six-month period of grace for valid payment of a renewal fee together with an additional fee provided for in Article 86(2) EPC.
After this decision and the amendments to Rules 85a, 85b and 104b EPC, Legal Advice No. 5/80 is now applicable only to the period of grace of Rule 85a(2) EPC (valid payment of the designation fees in respect of which the applicant has dispensed with notification under Rule 85a(1) EPC).
