Referral by the President of the European Patent Office
On 4 October 1991 the President of the European Patent Office referred the following point of law to the Enlarged Board of Appeal under Article 112(1)(b) EPC in order to ensure uniform application of the law:
When examining an opposition, is the Opposition Division obliged to consider all the grounds for opposition set out in Article 100 EPC or is the examination restricted to the grounds for opposition presented by the opponent?
The case is pending under Ref. No. G 10/91.
