    Decision of the Administrative Council of 20 October 1995 amending the European Patent Convention

    THE ADMINISTRATIVE COUNCIL OF THE EUROPEAN PATENT ORGANISATION,

    Having regard to the European Patent Convention ("EPC"), and in particular Article 33(1)(a) thereof,

    On a proposal from the President of the European Patent Office,

    Having regard to the opinion of the Committee on Patent Law,

    HAS DECIDED AS FOLLOWS:

    Article 1

    A new paragraph (6), the text of which is annexed to this decision, shall be added to Article 97 EPC.

    Article 2

    This decision shall enter into force on 1 January 1996.

    Article 97(6) EPC (new)

    (6) At the request of the applicant, mention of grant of the European patent shall be published before expiry of the time limit under paragraph 4 or 5. Such request may only be made if the requirements pursuant to paragraphs 2 and 5 are met.
