    New fee rates

    By Order No. 699/20031 of 31 July 2003 some patent fees of the Portuguese Patent Office have been changed.

    Proprietors of European patents with effect in Portugal are advised that from 1 August 2003 the following rates apply:

    1. Filing of European patent applications with INPI: filing fee: EUR 60

    2. Publication of translation of the claims pursuant to Article 67(3) EPC:

    Provisional protection, if the priority of a Portuguese patent or utility model application has been claimed:

    filing fee: EUR 60

    Provisional protection, if no priority of a Portuguese patent or utility model application has been claimed: filing fee: EUR 60 + provisional protection fee: EUR 50 = EUR 110

    In case of corrections, a special fee is charged amounting to EUR 10.

    3. Publication of translation of the patent specification under Article 65 EPC

    Validation of the European patent, if the priority of a Portuguese patent or utility model application has been claimed or if a translation of the claims has been filed with INPI for the purpose of provisional protection:

    filing fee: EUR 60

    Validation of the European patent, if no priority of a Portuguese patent or utility model application has been claimed or if no translation of the claims has been filed with INPI for the purpose of provisional protection:

    filing fee: EUR 60 + national validation fee: EUR 50 = EUR 110

    In case of corrections, a special fee is charged which may vary between EUR 10 and EUR 80.

    5. Conversion of European patent applications or patents into national patent applications or patents

    If the European patent application was filed with INPI:

    new publication fee: EUR 50

    fee for the 11th and each subsequent claim: EUR 10

    examination fee: EUR 200

    If the European patent application was not filed with INPI:

    filing fee: EUR 110

    fee for the 11th and each subsequent claim: EUR 10

    examination fee: EUR 200

    6. Registering a transfer, licences and other rights

    Assignment fee: EUR 80

    Licence fee: EUR 80

    Compulsory licence fee: EUR 150

    Updating of the information brochure "National law relating to the EPC"

    Users of the EPO information brochure "National law relating to the EPC" (12th edition) are asked to make the appropriate amendments to the amounts of fees shown in Tables II, column 5, III.B, columns 2 and 9, IV, columns 3 and 10, VI, column 1, VII, column 2, and IX, column 4.
