AT Austria

New fee rates

By the Law on Patent Office Fees 2004 ("Patentamtsgebührengesetz 2004")1 some patent fees of the Austrian Patent Office have been changed.

Applicants for and proprietors of European patents with effect in Austria are advised that from 1 July 2005 the following rates apply:

1. Publication of translations of the claims pursuant to Article 67(3) EPC:

EUR 150 plus EUR 130 for every 15 pages following the 16th page of the translation

2. Publication of translations of the patent specification under Article 65 EPC:

EUR 150 plus EUR 130 for every 15 pages following the 16th page of the translation

3. Renewal fees for European patents:

4. Conversion of European patent applications

(a) into a national patent application: EUR 180

(b) into a national utility model application: EUR 50

The request for conversion is liable to a document fee of EUR 13. A document fee of EUR 3.60 is charged for each page of enclosure, not exceeding EUR 21.80.

5. Registering a transfer of right, licences and other rights: EUR 70 per request and EUR 13 document fee.

Updating of the brochure "National law relating to the EPC"

Users of the EPO brochure "National law relating to the EPC" (12th edition) are asked to make the appropriate amendments to the amounts of fees shown in Tables III.B, column 2, IV, column 3, VI, column 1, VII, column 2, and IX, column 4.
