Decision of the Administrative Council of 28 October 2009 dispensing with the supplementary European search where the international search report or a supplementary international search report was drawn up by the European Patent Office (CA/D 11/09)
THE ADMINISTRATIVE COUNCIL OF THE EUROPEAN PATENT ORGANISATION,
Having regard to the European Patent Convention, and in particular Article 153(7) thereof,
On a proposal from the President of the European Patent Office,
Having regard to the opinion of the Budget and Finance Committee,
HAS DECIDED AS FOLLOWS:
Article 1
A supplementary European search report shall not be drawn up for international applications in respect of which the international search report or a supplementary international search report has been drawn up by the European Patent Office.
Article 2
This decision shall enter into force on 1 July 2010.
Article 3
The decision of 21 December 1978 (OJ EPO 1/1979, 4 and 2/1979, 50) and Article 1 of decision CA/D 41/07 of 25 October 2007 (OJ EPO 12/2007, 642) shall be rescinded as from 1 July 2010 and replaced by this decision.
