Schedule of fees and expenses of the EPO (applicable as from 1 April 2009)

The fees schedule shown here comprises all the fees and expenses of the EPO in euro effective as from 1 April 2009. It is based on the current version of the Rules relating to Fees as set out in the 13th edition (July 2007) of the European Patent Convention in conjunction with the decision of the Administrative Council of 25 October 2007 (CA/D 17/07, OJ EPO 2007, 533), the decision of the Administrative Council of 14 December 2007 (CA/D 16/07, OJ EPO 2008, 5), the decision of the Administrative Council of 14 December 2007 (CA/D 15/07, OJ EPO 2008, 10) and the decision of the Administrative Council of 12 December 2008 (CA/D 5/08, OJ EPO 2009, 7) as well as the decision of the President of the EPO dated 31 January 2008 (OJ EPO 2008, 202).

This schedule of fees contains a section 5 setting out all the fees for international applications for which the EPO acts as receiving Office, International Searching Authority or International Preliminary Examining Authority. Applicants are nevertheless recommended to check for any more recent updates to the PCT schedule of fees by consulting the WIPO website (www.wipo.int/export/sites/www/pct/en/fees.pdf) or the EPO online services website - under schedule of fees - (www.epoline.org/portal/public).

This schedule of fees replaces the previously published schedules.

1 The additional fee applies to European patent applications filed on or after 1 April 2009 and to international applications entering the regional phase on or after that date.

2 The amount of EUR 760 applies to a supplementary European search on an international application filed before 1.7.2005 (Art. 2, item 2, RFees); for European applications filed before 1.7.2005 the normal time limit for payment of the search fee has already expired. That amount also applies to the further search fee within the meaning of Rule 64(1) EPC, provided the relevant application was filed before 1.7.2005.

For European patent applications filed before 1 April 2009 and international applications entering the regional phase before that date, the Rules relating to Fees and the Implementing Regulations as in force until 31 March 2009 continue to apply, i.e. a claims fee is payable in the amount of EUR 200 for the sixteenth and each subsequent claim.
