Notice from the European Patent Office dated 7 March 2023 concerning the correction of the decision (CA/D 16/22, OJ EPO 2023, A2) of the Administrative Council of 14 December 2022 amending Article 2 of the Rules relating to Fees and adjusting the amount of the reduction in the fee for the supplementary European search where the international or supplementary international search report was drawn up by one of the European International Searching Authorities (CA/D 16/22 Corr. 1)

By decision CA/D 16/22 of 14 December 2022, the Administrative Council approved amendments to the Rules relating to Fees (RFees) applicable from 1 April 2023 (see OJ EPO 2023, A2).

In Article 2(1), item 2, first indent, RFees as set out in Article 1 of this decision, there is a list of provisions in brackets covering the cases in which the EPO raises a search fee in respect of a European or supplementary European search on an application filed on or after 1 July 2005.

This fee may also be due under Rule 56a(8) EPC (see CA/D 2/21, OJ EPO 2022, A3). However, Rule 56a(8) EPC was missing from the list of provisions.

The corrected version of decision CA/D 16/22 includes Rule 56a(8) EPC in this list to avoid any misunderstanding.
